Terms and conditions

1. General Conditions
   1. A reservation may be done via telephone, fax, internet - the web page of the TOUR OPERATOR, tour agents in the country or personally in the TOUR OPERATOR'S office. The reservation made shall be kept for 3 days after which period the travel has to be confirmed through paying a deposit, filing the required documents for the traveling as well as concluding of Contract for Organized Tourist Travel - COTT. The reservation shall be kept only after payment of deposit to the amount of 50 % per each person for all trips, unless otherwise provided by the particular program. The remaining amount of 50 % out of the total price shall be paid not later than 30 days before the date for trips to Asia and America, 20 days prior for Europe and 10 days prior Bulgaria. After failure to comply with the above-described conditions your excursion ordered shall be considered for cancelled and the deposit paid shall be deducted.
   2. Necessary documents and formalities.
      1. For trips to countries, requiring visas for Bulgarian citizens the TOUR OPERATOR shall cooperate to the USER by presenting to the last the required documents /reservations, vouchers, tickets, etc./. TOUR OPERATOR shall not guarantee receiving visa but shall undertake the obligation to provide necessary forms and deposit the USER'S documents to the respective Embassy. In that case the USER shall be obliged to provide the TOUR OPERATOR with the necessary documents as well as to pay the visa fees. Any failure to present the necessary documents, pay the fees due or reporting in the Embassy for personal interview shall be considered as refusal of the trip on USER fault.
      2. For persons of age under 18 years old who shall travel without their parents or with only one of them notary certified consent of the parents is needed - Certified copy is needed to be presented in the office 7 days before departure. The Original declaration of consent have to be with the child during the trip.
2. Prices and amendments
   1. The price may be amended in case of changes in the transport costs, including that of the fuel; Amount of fees in connection with the services as per the contract - airport, port etc. fees; Difference in the currency exchange rate at the moment of the present contract conclusion and the departure date.
   2. If price amendment is needed the Organizer shall be deemed obligated to protect the User's interest as per the conditions of Art. 35 of the Tourism Act. The price may be only amended in correspondence of with the actual component increase, which influenced the amendment.
   3. The price can not be increased when the travel date is closer than 20 days except in cases when the increase is because of inflation processes.
   4. The bus excursions shall be executed with minimum of 35 tourists, those with airplane - 150, unless otherwise provided.
   6. THE TOUR OPERATOR shall be entitled to make significant changes in a material clause if the USER had been informed prior the contract conclusion or after that with written agreement between the Parties. In that case the tourist shall be entitled to:
      1. accept the amendments;
      2. to make the tourist traveling but on other date;
      3. to purchase other traveling;
      4. refuse the contract, without owing any forfeit or being subject of compensation.
      The TOUR OPERATOR shall repay to the USER the amounts given by him within 7-day period.
   7. The above-described conditions shall not be effective in case that the traveling is cancelled by the User.
3. Cancellations
   1. The User shall be entitled to refuse the contract or to assign it to other person 20 days prior the trip for Europe /30 for America and Asia/ without owing any forfeit and the deposit made shall be repaid to him, unless otherwise provided. 100 BGN for administrative costs shall be deducted.
   2. The Cancellation have to be made by the USER personally, the one who signed the contract and on the place of signing. In case of cancellation after the term as per i. IV.1 the tourist shall loose, respectively shall owe a payment to the TOUR OPERATOR in the form of forfeit the amount of:
      1. 30 % of the travel price, if the cancellation is made within the period 30 to 21 days prior the departure date and
      2. 70 % of the travel price, if the cancellation is made within the period 20 to 15 days prior the departure date and
      3. If the cancellation is made 14 or less days before the departure date a forfeit to the amount of 100% of the price is owed.
4. Claims
   1. The User is expected to notify immediately on the spot the suppliers of services as well as the TOUR OPERATOR for each incorrect implementation of the contract. The notification has to be made in written form, including through telex, e-mail or other technical device. The TOUR OPERATOR or its local representative shall be deemed obligated to make any reasonable efforts promptly to specify the case and satisfy the USERS violated rights.
   2. If this turns out to be impossible and the TOURIST claims are not satisfied the last shall be entitled to ask from the TOUR OPERATOR representative, the serving company, the site being placed to prepare ascertainment report with the non received services or those with decreased level of quality signed by both Parties. If such report is missing the TOUR OPERATOR can not guarantee any favourable result from the claim made.
   3. The report made shall be presented personally to the TOUR OPERATOR or shall be send via mail with registered letter at latest in 3-day period after the returning in Bulgaria. THE TOUR OPERATOR shall be deemed obligated to give written answer to the claim made in one-month period.
5. Liability
   1. The TOUR OPERATOR shall bear full responsibility for the implementation if the present contract term and conditions.
   2. The TOUR OPERATOR shall not be responsible for any damages caused because of failure of implementation or incorrect contract implementation which are caused by the Client (incl. failure to be present on the designated place for departure), third parties actions, who are not connected with the present contract implementation which may not be foreseen and / or avoided, forces out of the scope of the Parties, events caused by Force Major circumstances.
   3. The USER shall be entitled and shall be deemed obligated to get introduced in details with the currency-customs regime as well as with the leaving / arriving in Bulgaria, as well as the country, subject of visit. To observe this country laws as well as to leave the country where the excursion / vacation is, in accordance with the contract together with the tourist group to which they belong or individually /in case of individual trip/. All USER'S actions in violation of the law of the respective country, as well as all resulting events shall be on his expenses. In such cases the TOUR OPERATOR shall not bear responsibility for the costs and formalities in connection with the USER returning in Bulgaria.
   4. If the USER causes any damages to hotels, transport vehicles or to any third parties the latter shall be deemed obligated to recover the caused and proved damages on the spot.
   5. Each USER who has planned to travel and stay in countries with increased risk for infectious diseases the latter shall be deemed obligated to pass the respective prophylaxis in accordance with the international medical requirements.
   6. . If during their stay in foreign country the USER looses his identification documents he shall be deemed obligated to inform the closest Embassy of the Republic of Bulgaria. In such cases the TOUR OPERATOR may cooperate and help but all costs in that connection shall be on expenses of the USER.
6. Insurances
   1. The offered insurance in the tourist packet is included in the price. Assistance, coverage of medical costs resulting from accident or disease, transport, repatriation, emergency dental help and the insurance shall be in force from the date and place of departure to the date and place of arriving. People of age above 65 years old shall pay + 50% , over 70 years old + 100 %, over 75 years old + 200 % of the insurance policy price.
   2. Siam Air Tour Ltd. has a contract for insurance in accordance with Art. 42 of the Tourism Act Covering its liability for any damages caused in result of not settling payment with their counteragents, including gin state of insolvency or bankruptcy as per the Conditions of Insurance Policy 0000033059 dated 08.08.2007 - valid from 09.08.2007 up to 08.08.2008 issued by Armeec Insurance Stock Company, Sofia 1000, 2 Stefan Karadzha Str., tel. / fax : 02 / 9811340; e-mail: office@armeec.bg
7. Final Stipulations.
   1. The USER with the consent of the TOUR OPERATOR my appoint other person to be entitled with his rights in connection with the organized travel as per the terms and conditions of the Tourism Act and the present contract. Such cases shall be allowed if the transfer will not complicate the travel organization and the claim is made earlier than 10 day before the date of departure. This person shall be in correspondence with all requirements for the trip implementation. In case of the USER replacement the TOUR OPERATOR shall be entitled to change the price in accordance with the possibility to realize the replacement. The USER transferring his rights and obligations and the person of replacement shall have mutual liability before the TOUR OPERATOR or the TOURIST AGENT for the general price as per the contract as well as the costs in connection with the replacement.
